Builders Must Consider Protecting the Population in Shelters: Legislative Change

Soon, developers will be required to add a section on engineering and technical civil defense measures to project documentation for construction. This section may include the construction of protective structures or dual-purpose facilities.

This regulation is introduced by the Law “On Amendments to Certain Legislative Acts of Ukraine Regarding Ensuring Civil Defense Requirements During Planning and Development of Territories” dated July 29, 2022, which comes into force on October 24, 2022.

This regulation is the state’s response to the full-scale war in Ukraine and the desire to provide the population with places where they can hide from potential shelling and other dangers of war.

The requirement applies to construction projects where more than 50 people will be permanently present or more than 100 people will be present periodically. The legislative change is relevant for both residential and non-residential buildings. The main requirement is the number of people who will permanently or periodically be in the building.

The law requires developers to provide shelters or other measures to protect people during hostilities. For example, this could be access to a nearby shelter (which can be reached within 1-3 minutes, according to a letter from the State Emergency Service of Ukraine dated August 30, 2017, No. 02-12284/162).

Also, solutions for protecting the population must meet accessibility requirements for people with disabilities and other low-mobility groups.
